Obligation of Sports Bodies to Adapt Their Articles of Association to the New Provisions of Sports Law

With Law 4726/2020 (Government Gazette) A 181/18.9.2020) "Renovation of institutional frameworks of the archaeology of sports bodies, distinguished athletes' escorts of disabled persons, establishment of a National Athletic Integrity Platform, Greek Olympic Committee (E.O.E.), Greek Paralympic Committee (E.P.E.) and other provisions" were amended important provisions of Law 2725/1999 on amateur sport. These amendments concern, inter alia, the obstacles to the registration of new members in sports clubs, general assemblies and archaeology of sports bodies (sport clubs, sports associations and sports federations).

Sports clubs and other sports organisations are obliged to amend their statutes and adapt them to the new provisions by 30.06.2021. Otherwise, special sporting recognition is automatically lifted.

In particular, the relevant provision is as follows: Pursuant to Article 30(1) of Law No.4726/2020, FEK A 181/18.9.2020: ‘By 30.06.2021, sports clubs, sports associations and sports federations must amend their statutes for the purpose of adapting it to Articles 5, 14, 22 and 24 of Law 2725/1999, as amended and replaced by Articles 2, 5, 6 and 7 of this Regulation. Until the Statute has been adjusted in accordance with this paragraph, the provisions of the first subparagraph shall apply to any different statutory rules. In the event of the expiry of the above period, the specific sporting recognition which has either been granted in accordance with Articles 8 and 28 of Law 2725/1999 or is deemed to have been granted in accordance with paragraph 5 of Article 135 of that Act shall be automatically withdrawn. The relevant finding act on the automatic lifting of specific sporting recognition is issued by the competent body of the Ministry of Culture and Sports."
